14th March, 1930.
With reference to your letter (72765/30) of the
4th March, transmitting a copy of the Hong Kong Companies
Amendment Ordinance, 1929, I am directed by the Board of
Trade to state, for the information of Lord Passfield,
that they have no observations to make on Clause 2 of
the Ordinance, but with regard to Clause 3, which appears
to be founded upon the provisions of Sections 34 and 35
of the Companies (Consolidation) Act, 1908, I am to
point out that Section 34 was amended by the Companies
Act, 1928, and the notices required to be sent to the
Registrar are now under Section 103 of the Companies Act,
1929, to be sent within 14 days of the opening of the
office or the change or discontinuance as the case may
be. A penalty for default in complying with this
Subsection has also been inserted in the 1929 Act, and
The Under Secretary of State,
